Our total liability for any claims arising from or related to your use of the website shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Dispute Resolution

Any disputes arising out of or relating to these Terms of Use or your use of the website shall be resolved through good faith negotiations. If we cannot resolve a dispute through negotiation, you agree to first attempt to resolve it through mediation conducted by a mutually agreed-upon mediator. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against us. Any arbitration will take place in Bangor, Maine, and will be conducted in English.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the federal or state courts located in Bangor, Maine, and you hereby consent to the personal jurisdiction and venue of such courts.

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms of Use constitute the entire agreement between you and Comfortatelier regarding the use of the website.
